The State Bar of Michigan's Journal of Insurance and Indemnity just published Doug's new article on agent errors and omissions. You can read it here, starting on page 5. Sometimes though, an insurance agent negligently fails to procure the correct insurance for a property, and the coverage gap isn't noticed until a loss occurs, revealing the absence or insufficiency of the necessary coverage. In these cases, it may be necessary to sue the agency, which is typically able to pay out of its own professional errors and omissions insurance.
